Terms of Service

These Terms of Service ("Terms") govern your use of CourtKeeper, a software service provided by Kevin C Vroman doing business as CourtKeeper ("CourtKeeper," "we," "us"). By creating an account or using the service, you agree to these Terms.

The service

CourtKeeper is a software platform that country clubs use to manage their tennis and pickleball departments: court reservations, lesson bookings, availability pools, member-pro communication, and related administrative functions. CourtKeeper is provided to clubs under a subscription. Individual members access CourtKeeper through their club.

Accounts

You must provide accurate information and keep your account credentials secure. You are responsible for activity that occurs under your account. Notify us at support@courtkeeper.io if you believe your account has been compromised.

Acceptable use

You agree not to: (a) use CourtKeeper for any unlawful purpose, (b) harass or abuse other members or staff through CourtKeeper's messaging features, (c) attempt to gain unauthorized access to other accounts or the underlying systems, (d) interfere with or disrupt the service, or (e) use automated tools to scrape, copy, or reverse-engineer the service.

SMS messaging program

Program: CourtKeeper SMS, operated by CourtKeeper on behalf of participating country clubs.

Message types: Announcements deliberately written and sent by authorized head-pro staff, including weather closures, court maintenance, schedule changes, program and event announcements, and other club communications. Automated reservation, availability-pool, lesson, clinic, and account notifications are delivered through the app, push notifications, or email rather than SMS.

Enrollment: SMS is optional. Members may opt in with the unchecked SMS consent box under My account > Notifications. Consent is not required to use CourtKeeper.

Message frequency: Varies based on announcements sent by your club's head-pro staff.

Msg & data rates may apply. Standard message and data rates from your wireless carrier apply to all SMS messages.

Opt out: Reply STOP to any CourtKeeper SMS message at any time to unsubscribe. You will receive a confirmation message and no further SMS will be sent. You can also disable SMS in your in-app notification settings.

Help: Reply HELP to any CourtKeeper SMS message for help, or email support@courtkeeper.io.

Carriers: Carriers are not liable for delayed or undelivered messages.

Billing (for club accounts)

Clubs are billed monthly under a subscription agreement. Specific pricing, payment terms, and cancellation policy are described in the club's subscription agreement. Individual members do not pay CourtKeeper directly; member access is funded by the club.

Suspension and termination

We may suspend or terminate accounts that violate these Terms or that are part of a club whose subscription has lapsed. You may stop using CourtKeeper at any time. If your club ends its subscription, your account will be deactivated and your data deleted per our Privacy Policy.

Disclaimers

CourtKeeper is provided "as is" and "as available." We do not guarantee that the service will be uninterrupted, error-free, or that every message will be delivered on time. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability and fitness for a particular purpose.

Limitation of liability

To the maximum extent permitted by law, CourtKeeper's total liability arising out of or relating to the service will not exceed the amount paid by your club to CourtKeeper in the twelve months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in Ventura County, California.

Changes to these Terms

We may update these Terms as the service evolves. Material changes will be announced via email to account holders at least 30 days before taking effect. Continued use of the service after the effective date constitutes acceptance.
